These Terms of Use (“Terms”) govern your access to and use of ZipAgent LLC’s website, forms, and services (the “Services”). By using the Services, you agree to these Terms.

1. Who the Services are for

ZipAgent is intended for licensed real estate professionals and teams who want verified homeowner introductions and related services, as well as homeowners who choose to request an introduction. You are responsible for ensuring your use complies with applicable laws, brokerage policies, and professional requirements.

2. No guarantee of results

We work to verify intent and contact information before introductions are delivered, but we do not guarantee a particular outcome, including listings, conversions, transaction volume, or revenue. Markets vary and performance depends on many factors outside our control.

3. Communications (calls, email, SMS)

If you contact us or request information, we may respond by email or phone as appropriate to your request. SMS messages are sent only if you opt in through the chat widget on pages where it appears, or if you use the transactional SMS consent checkbox on our Contact page (which does not load the chat widget) (as described in our Privacy Policy). SMS are non-marketing and service-related only, such as lead updates, scheduling, verification, and account-related notices. Message frequency varies. Message and data rates may apply. You can opt out of SMS at any time by replying STOP.

Carriers are not liable for delayed or undelivered messages. You must be 18 years of age or older to use this SMS service. For details on how we collect and use information, see our Privacy Policy.

4. Acceptable use

• You will not misuse the Services, attempt to access systems without authorization, or interfere with site performance.
• You will not use the Services to harass, spam, or violate applicable consumer protection or telemarketing laws.
• You are responsible for your outreach, follow-up, and compliance with all applicable regulations.

5. Payments and billing

If you purchase a plan (pay-per-lead, monthly, outbound specialist services, or custom packages), pricing and billing terms may be provided separately in an order form, invoice, or written agreement. Those terms control in the event of any conflict with these Terms.

6. Intellectual property

The Services and all content, branding, and materials are owned by ZipAgent or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

7. Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, ZipAgent disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, ZipAgent will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising out of or related to your use of the Services.

9. Changes

We may update these Terms from time to time. The “Last updated” date will change, and the updated Terms will apply when posted.
